ABC has filed a First Amendment lawsuit against the Federal Communications Commission (FCC), accusing the agency of undertaking a retaliatory campaign against the network. The lawsuit claims that the Trump Administration is targeting ABC for its disapproval of the network’s broadcasts, particularly its handling of a live primetime address by President Donald Trump last month.

The FCC had instructed ABC to file renewal applications for eight of its stations within 30 days, a process that normally takes months to prepare. However, ABC submitted the applications under protest, citing the unusual timing and the fact that the licenses were not due for renewal for at least 2.5 years in some cases. The lawsuit argues that the FCC’s actions are a clear attempt to intimidate and coerce ABC into broadcasting only favorable stories.
The complaint states that the Trump Administration has been steadily increasing the pressure on ABC for months, targeting the network’s parent company, Disney, with FCC probes and investigations. The agency opened an investigation into Disney’s diversity, equity, and inclusion practices last year, accusing the company of violating equal employment opportunity rules. If the Administration gets its way, the message to every media company in the country will be unmistakable: tell only the stories the Administration deems favorable, or face the coercive machinery of the federal government. In such a world, the press could in no way be described as free.
The FCC Chairman, Brendan Carr, has publicly touted the Administration’s success in extracting speech-related concessions from other media companies, boasting that it has ‘taken on the fake news media’ and is ‘winning.’ He has also cataloged with evident pride the perceived critical voices that have been taken off the air. The lawsuit argues that this is a clear attempt to undermine the First Amendment and restrict the freedom of the press.
ABC is asking a court to halt the early license renewal process and to declare that the FCC’s actions are unconstitutional.
