Hong Kong Conglomerate CK Hutchison Files $1.5 Billion Damages Claim against Panama
Hong Kong-based conglomerate CK Hutchison has initiated new arbitration proceedings against the Panamanian government, seeking over $1.5 billion in damages for the country’s seizure of two key ports at the ends of the Panama Canal.
According to a statement released by CK Hutchison, the company has begun the new arbitration proceedings against Panama, alleging that the country breached an investment protection treaty through ‘sovereign acts that targeted a decades-old ports concession’ in a ‘state attack campaign’ on the company’s assets in Panama.
The Panamanian government seized the Balboa and Cristobal ports in February, after its Supreme Court ruled that a concession held by CK Hutchison’s subsidiary, Panama Ports Company, to run the two ports was unconstitutional. The Panama Ports Company had operated the two ports since 1997 and had renewed its concession for 25 years in 2021.
The takeover of the ports has become a focal point in the escalating tensions between the United States, China, and Panama. The Panama Canal is a critical waterway that connects the Atlantic and Pacific Oceans, and the ports at its ends are a crucial hub for international trade.
CK Hutchison’s subsidiary, Panama Ports Company, has separately sought at least $2 billion in compensation from Panama over its takeover of the ports, which it claims was unlawful under international arbitration proceedings. CK Hutchison has emphasized that the new arbitration proceedings are focused on its treaty rights, which are distinct from Panama Ports Company’s contract rights in the earlier arbitration proceedings. The company’s statement also mentioned that it had announced an initial $23 billion deal to sell its global ports business, including the two Panama ports, to a consortium involving US investment firm BlackRock last year. However, the deal had made little progress under the ongoing geopolitical tensions and legal challenges among China, the US, and Panama.
CK Hutchison has stressed that it is committed to protecting its treaty rights and will continue to pursue all available legal options to address the Panamanian government’s actions. The company’s actions have been supported by Beijing and Hong Kong, which have criticized Panama’s takeover of the ports.
In addition to its arbitration proceedings against Panama, CK Hutchison has also launched arbitration proceedings against Danish shipping and logistics group Maersk after it took over some of its port operations in Panama. Maersk has stated that it does not believe it is liable for the claims.
