ICE Arrests Boat Captain in New York Harbor Crash that Killed 2
The U.S. Immigration and Customs Enforcement (ICE) has arrested Manuel Ernesto Hermandez-Umana, the 46-year-old boat captain who was involved in a fatal crash in New York Harbor on August 8.
Hermandez-Umana, who is from El Salvador, was at the helm of a 21-foot boat when it overturned near the Statue of Liberty, killing a 27-year-old woman, Sara Sanchez, and her 5-month-old daughter, Antonella Garcia. The incident occurred in a swell, with prosecutors stating that Hermandez-Umana piloted the boat into the swell and accelerated the throttle in an attempt to pass through it.
According to the complaint filed against Hermandez-Umana, the swell swamped the bow of the boat, causing it to capsize. The investigation revealed that there were no infant life vests aboard the vessel.
Hermandez-Umana is facing federal charges of misconduct and neglect of a ship officer resulting in death. He did not enter a plea in federal court on August 10, when he was released on a $50,000 personal recognizance bond. He is barred from operating a boat or vessel until his next court date on September 9.
In addition to federal charges, Hermandez-Umana also faces state charges, including 13 counts of reckless endangerment, filed by the New York Police Department.
Department of Homeland Security (DHS) Secretary Markwayne Mullin stated that once Hermandez-Umana faces justice for his crimes, he will be swiftly removed from the country. Hermandez-Umana has been in the United States since 2007, when he entered the country illegally through Texas. He told a Customs and Border Protection officer that he was a U.S. citizen to gain entry into the country.
